Upon the catalogue of celebrated litigations the case of Slade vs. Slade, before the Court of Exchequer in England, which, as we see, has recently been settled by the parties, must take a prominent place, not by reason of the importance of the questions which it determined, for it determined nothing, but by reason of the interesting character of the facts and the heavy anti fruitless expense attending the litigation.
It seems that in 1824 an English girl named Barbara Moyston, being with her mother, who was a widow, in Milan, there made the acquaintance of a Lieutenant in the Austrian Engineers, named Baron Von Korber. They became attached to each other, and on 6 Oct 1825, a ceremony of marriage between them was performed at the Church of San Fedele in Milan. The Baron was a Protestant, while the lady was a Catholic, and such marriages being forbidden by the Church in Lombardy at that time, the Priest of the Parish in which Miss Moyston lived had refused to perform the ceremony. The BaronÂ’s military resources, however, had availed him, and a Hungarian Priest, who was a military chaplain, was called in,and having no such scruples, performed the ceremony. The Baron was very soon ordered away on service, and his wife went with him to Vienna,but before they had been married six months, the pair had separated. The lady finding her husband to have a violent temper, and becoming also satisfied of his infidelity, sought redress, and commenced a suit in Vienna to obtain a separation. The Baron, true to his military habits, not only resisted the suit, but came with a file of soldiers at hisback to the hotel where the plaintiff was staying, and undertook to carry her off by force, a summary, but not very satisfactory way of disposing of the suit. It happened that an English lawyer named FrederickSlade was at the hotel He interfered, and was as successful as if he had been the hero in a novel, in saving the young lady from her pursuer. The Baron being thus reduced to the ordinary forms of litigation, succumbed, and, in consideration of certain sums to be paid him, agreednot to molest the lady any more, and she and her mother returned to England, where, with due regard to the requirements of gratitude, she bestowed her affections on her deliverer. As the Baron was still alive it became necessary to find some way of getting rid of him, and the shortest way was determined to be to act as if there had been no marriage at all. Ecclesiastical authorities declared that the Milanese marriage was null and void, and the fact that the lady had lived with a man six months without being married to him not being a sufficient ground of objection in the mind of Sir Frederick to his marrying her, that view was adopted, and that course was pursued. Eight children were born of this second marriage, and all seems to have gone well enough till the death of Sir Frederick Slade, when his property and his title were at once claimed by his brother, who set up that the first marriage wasvalid, and the second one bigamous; that the children born of it wereillegitimate, and he the sole heir to the property. The eldest son, however, being in possession, the result was a suit brought by his uncle against him to determine the question of legitimacy. The suit attracted the greater interest from the fact that Sir Fredrick was a prominent member of the Bar, a QueenÂ’s Counsel, who had, however, in this marriage exemplified the proverbial carelessness or recklessness of lawyers when called upon to deal with legal questions in their own affairs.

The suit went on at great expense; evidence was taken at great lengthas to the marriage law of Austria and of Milan; the widow was examined fully as to all the circumstances of her two marriages, and the legal questions were argued by eminent counsel before the Court. But when the Judges, who were four in number, came to declare their opinions, it was found that two of them were in favour of each party, so that no decision could be rendered.
The practice in that Court, in such a position of affairs is that if the parties desire to appeal the junior Judge withdraws, to enable a decision to be rendered. The question of costs became in this case became an important one, they having already run up to a very heavy figure. The parties finally came to the conclusion to go no further, but to treat the second marriage as valid, as it had been considered before the death of Sir Frederick, the plaintiff in the ease agreeing to give a release of his claims on being paid the sum of £28000. Of this sum £16,000 are the plaintiffs costs, while the defendant’s costs amountto some £10,000 more, which he will have to pay. This sum of $100,000, paid as costs in one litigation, which never went to an appeal, sounds large to our ears even in these days of tedious legal proceedings.Sir Fredericks name may fairly claim consideration along with that of“the man who makes his own will,” as a benefactor to the legal profession.
